Krust is an AI-powered content creation platform that enables users to:

• Create AI-generated UGC (user-generated content) video advertisements using multiple video styles including Selfie Testimonial, Product Testimonial, and Before & After
• Generate AI images and video clips through Spaces, a visual canvas for creative workflows
• Upload reference photos for AI face swap in video generation
• Upload and manage product images for integration into AI-generated content
• Select from multiple AI video generation models (including VEO and Kling)
• Combine generated video scenes into final output videos

The Service is provided on an "as is" and "as available" basis. We are a creative services platform and do not guarantee specific advertising results, performance outcomes, or that generated content will be identical across generations.

To access the Service, you must create an account via email, Google, or Apple authentication. By registering, you:

• Confirm that you are at least 18 years old
• Agree to provide accurate and truthful information
• Agree to keep your login credentials secure and not share them with third parties
• Accept responsibility for all activity conducted through your account
• Agree to notify us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate your account if you violate these Terms or if your account activity poses a risk to the Service or other users.

Credit System:

The Service operates on a credit-based system. Credits are consumed when you generate content:

• Video scene generation: 2–20 credits per scene depending on AI model — Kling 2.6 (2–8), Kling 3.0 Pro (3–20), VEO Fast (3), VEO Quality (14)
• Image generation: 1 credit per image

Subscription Plans:

Your plan determines the number of credits you receive each billing cycle. Available plans include Starter, Growth, Business, and Unlimited tiers. Current pricing and credit allocations are displayed on our website and within the Service. All plans include access to all AI models and features.

Credit Renewal:

Credits are replenished to your plan amount on each billing anniversary date. Unused credits from the previous billing period do not carry over and are forfeited. Credits have no monetary value and cannot be transferred, sold, or exchanged.

Refunds on Failed Generations:

If a generation fails due to a system error, the credits consumed for that generation are automatically refunded to your balance. Retries on failed generations do not incur additional credit charges.

Fees:

You agree to pay all fees associated with your chosen subscription plan as specified on our website. All fees are quoted in USD. Prices are exclusive of applicable taxes unless otherwise stated. You are responsible for any taxes applicable in your jurisdiction.

Billing:

Subscriptions are billed on a recurring basis (monthly or yearly, depending on your selection). Payment is processed through our payment provider, Stripe. You authorize us to charge your designated payment method for all applicable fees. Yearly billing provides a discount equivalent to approximately 20% off the monthly rate.

Upgrades & Downgrades:

Plan upgrades take effect immediately. You will be charged the prorated price difference and receive additional credits instantly. Plan downgrades are scheduled for the next billing cycle — you retain your current plan benefits until the current period ends.

Refund Policy:

Subscription fees are generally non-refundable. Unused credits are not eligible for refund. All refund requests are reviewed on a case-by-case basis at the sole discretion of Krust. We reserve the right to approve or deny any refund request based on the circumstances, including but not limited to usage history, account activity, and the nature of the request. To request a refund, contact us at info@trykrust.com within 14 days of the charge. Refund decisions are final.

Your Content:

You retain ownership of all content you upload to the Service ("Your Content"), including reference photos, product images, scripts, and brand materials. By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and modify such content solely for the purpose of providing and improving the Service.

Generated Content:

AI-generated content (videos, images) created using the Service belongs to you, subject to the following conditions:

• You have an active subscription and have paid all applicable fees
• You comply with these Terms and the Acceptable Use policy
• Due to the nature of AI generation, we cannot guarantee that generated content will be unique or that similar content will not be generated for other users

You may use generated content for commercial purposes, including advertising, social media, and marketing campaigns. You are solely responsible for ensuring that your use of generated content complies with applicable laws and does not infringe on the rights of third parties.

Permitted Modifications:

You may modify generated content by cropping, adding music, text, subtitles, sound effects, B-roll, or other overlays. You may not use generated content to create deepfakes, impersonate real individuals without their consent, or produce misleading or harmful content.

Our Intellectual Property:

The Service, including our AI technology, software, website, brand, and all related intellectual property, remains our exclusive property. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on our platform or AI models.

The Service includes AI face swap functionality that uses reference photos you upload. By uploading reference photos, you represent and warrant that:

• You have obtained the explicit consent of the individual depicted in the photo for use in AI-generated video content
• You have the legal right to use the image for commercial purposes
• The photo does not depict a minor (under 18 years old)
• The generated content will not be used to deceive, defame, harass, or harm any individual

We reserve the right to reject or remove reference photos that violate our content moderation policies. You are solely responsible for obtaining and maintaining all necessary consents and rights related to the individuals depicted in your reference photos.

By using the Service, you agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose
• Generate content that is defamatory, obscene, discriminatory, threatening, or harassing
• Create deepfake content or content designed to impersonate real individuals without their consent
• Generate content that promotes violence, hate speech, terrorism, or illegal activities
• Use the Service to create misleading political content or disinformation
• Upload content that infringes on the intellectual property or privacy rights of third parties
• Use automated tools (bots, scrapers) to collect data from or interact with the Service without permission
• Attempt to reverse-engineer, decompile, or extract our AI models, algorithms, or source code
• Resell, sublicense, or provide unauthorized access to the Service to third parties
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent any security measures, rate limits, or content moderation systems

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account without refund. You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these terms.

The Service uses artificial intelligence to generate video and image content. You acknowledge and agree that:

• AI-generated content may not always meet your expectations in terms of quality, accuracy, or likeness
• Multiple generation attempts may be necessary to achieve satisfactory results
• We do not guarantee that generated content will be free of artifacts, distortions, or imperfections
• Generated content may occasionally be flagged or rejected by our content moderation systems
• The quality and characteristics of generated content may vary between different AI models
• You are responsible for reviewing all generated content before use and ensuring it meets your requirements and complies with applicable laws

Video Templates:

All video templates available in the Krust Template Gallery are created and generated using artificial intelligence. Templates are provided as starting points and illustrative examples of what the Service can produce — they are not recordings of real people or real events. Any resemblance to real persons in template-generated content is entirely coincidental and is a result of AI synthesis. When you select a template and generate content from it, the resulting video is uniquely produced by AI specifically for your use. You assume full responsibility for:

• Reviewing and approving all content generated from any template before publishing or distributing it
• Ensuring that your use of template-based generated content complies with applicable laws, advertising regulations, and platform policies
• Verifying that generated content does not infringe on the intellectual property, likeness, or other rights of any third party
• Any claims, damages, or liabilities arising from the publication or use of content generated from templates

Krust bears no responsibility for how template-based generated content is used, distributed, or represented after it is downloaded by you.

We strive to ensure continuous Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will endeavor to provide advance notice)
• Unexpected technical issues or infrastructure failures
• Third-party service disruptions (AI model providers, cloud infrastructure, payment processors)
• Force majeure circumstances

We are not liable for any losses or damages arising from Service unavailability. Generated content and uploaded assets are stored on cloud infrastructure; however, we recommend downloading important content promptly.

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
• We are not liable for damages arising from AI-generated content or its use, including any claims from third parties
• We are not liable for Service interruptions, technical issues, or data loss
• We are not liable for the actions, service quality, or availability of third-party AI model providers
• Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim

This limitation does not apply in cases of intentional misconduct or gross negligence, or where such limitation is prohibited by applicable law (including mandatory consumer protection laws).

Your Right to Terminate:

You may cancel your subscription at any time through Settings > Billing. Your plan remains active until the end of the current billing period. You may also request account deletion by contacting us at info@trykrust.com. Upon termination, you are responsible for downloading any content you wish to retain.

Our Right to Terminate:

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or the Acceptable Use policy
• You use the Service for illegal purposes
• Your activity harms other users or the integrity of the Service
• You fail to pay applicable fees
• You provide false or misleading information

Upon termination, your access to the Service and all generated content will be revoked. Any unused credits are forfeited and are not eligible for refund.

If you are a consumer (an individual using the Service for personal purposes), you may have additional rights under consumer protection laws in your jurisdiction.

For EU consumers: Since the Service is a paid digital service, the standard 14-day withdrawal right may apply unless service delivery has begun with your explicit consent. By subscribing and using credits to generate content, you acknowledge that the service has begun and you may waive your right of withdrawal for the credits consumed. Please contact us for more information about your specific rights.

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 10 days in advance by:

• Displaying a notice within the Service
• Sending an email notification to your registered email address

By continuing to use the Service after changes take effect, you agree to the updated Terms. If you do not agree with the changes, you may cancel your subscription before the changes take effect.

If a dispute arises, please first contact us at info@trykrust.com. We will endeavor to resolve the issue within 14 days through good-faith negotiation.

If the dispute cannot be resolved directly, you may:

• Contact consumer protection authorities in your jurisdiction
• Use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

These Terms are governed by the laws of the Republic of Lithuania. Any disputes arising from these Terms shall be resolved in the courts of Vilnius, Lithuania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
